These Terms of Service govern use of MarketVista AI, including the website, dashboard, market tools, research pages, education system, FAQ, support center, plugins, themes, AI features, market data, scanners, signals, forecasts, watchlists, journals, paper trading, webhooks, and automation systems.

1. Educational Technology Only
MarketVista AI is educational and decision-support technology. It is not a broker-dealer, registered investment adviser, tax adviser, legal adviser, fiduciary, exchange, bank, custodian, or guaranteed trading system unless a separate written agreement signed by authorized parties says otherwise.

2. No Financial, Tax, or Legal Advice
All content, market data, AI outputs, signals, forecasts, scanner results, ratings, scores, charts, alerts, education, paper trades, and automation suggestions are informational and educational. Users are solely responsible for decisions and should consult qualified professionals.

3. Trading and Investing Risk
Trading and investing involve substantial risk, including loss of principal. Past performance, paper results, backtests, scores, forecasts, probabilities, AI output, and market signals do not guarantee future results.

4. Live Data Risk
Market data may be live, delayed, stale, provider-pending, unavailable, inaccurate, or incomplete. Users must verify important data before action. MV and its owners are not liable for provider outages, delays, errors, incorrect symbols, or stale data.

5. AI and Automation Risk
AI may produce incorrect, incomplete, outdated, or misleading information. Automation may malfunction, reject trades, duplicate checks, fail safety checks, or be disabled. Users must supervise automation and accept all risk from use.

6. Paper-First and Live Broker Lock
Autonomous trading features are paper-first. Live broker routing must remain disabled unless the full owner-approved safety workflow is intentionally enabled, including MFA, owner approval, broker readiness, supervised tiny-size mode, kill switches, max-loss controls, cooldowns, duplicate protection, audit logging, and export.

7. User Responsibilities
Users must provide accurate information, protect login credentials, comply with broker and data-provider terms, avoid scraping or abusive automation, avoid unlawful activity, and use the platform responsibly.

8. Prohibited Use
Users may not use MarketVista AI for market manipulation, illegal trading, fraud, unauthorized scraping, reverse engineering, credential sharing, circumvention of safety gates, harassment, malware, excessive automated requests, or violation of third-party rights.

9. Third-Party Services
MarketVista AI may integrate charting, market data, news, broker, AI, hosting, payment, authentication, and communication providers. Third-party services are governed by their own terms. MV does not control or guarantee them.

10. Accounts, Subscriptions, and Pricing
Plans, features, limits, pricing, and access may change. Super admins may configure pricing packages. Billing terms may be supplemented by checkout or subscription provider terms.

11. Plugins and Themes
Plugins and themes are expandable platform components. Uploaded plugins may be staged, reviewed, disabled, deleted, or blocked for safety. MV may reject plugins that create security, performance, legal, or architecture risks.

12. Intellectual Property
MarketVista AI, platform design, workflows, software, branding, documentation, content, and systems are owned by MV or licensors. Users receive only a limited, revocable, non-transferable right to use the platform.

13. Disclaimers
The platform is provided as-is and as-available to the maximum extent allowed by law. MV disclaims warranties of accuracy, merchantability, fitness for purpose, uptime, profitability, and non-infringement where permitted.

14. Limitation of Liability
To the maximum extent allowed by law, MarketVista AI, owners, operators, affiliates, employees, contractors, licensors, data providers, and service providers are not liable for trading losses, investment losses, lost profits, lost data, business interruption, missed opportunities, provider failures, AI errors, broker issues, or indirect/consequential damages.

15. Indemnification
Users agree to defend and indemnify MarketVista AI and its owners/operators from claims arising from misuse, unlawful conduct, violation of these Terms, violation of third-party terms, or trading/investment decisions.

16. Account Suspension
MV may suspend, restrict, or terminate access to protect the platform, users, owners, data providers, security, legal compliance, or operational stability.

17. Florida Law and Venue
To the maximum extent permitted, these Terms are governed by Florida law, with disputes handled in an appropriate Florida venue, unless applicable law requires otherwise.

18. Changes
MV may update these Terms. Continued use after updates means acceptance to the extent allowed by law.
